Yet, managing “dispute risk” is often not given the same attention as managing IP, financial, technical or other aspects of a deal, despite the fact that it should be considered a normal and expected part of any collaboration and planned for accordingly. Contract disputes with partners can create tremendous business, financial and legal risks.  Yet, managing “dispute risk” is often not given the same attention as managing IP, financial, technical or other aspects of a deal, despite the fact that it should be considered a normal and expected part of any collaboration and planned for accordingly. 

Alliance professionals working with their legal colleagues need to focus on conflict management with an effective toolkit at every stage of the development of an agreement: negotiation, drafting and implementation over the long term.

This interactive program will begin with a discussion of participant examples of conflicts they have faced in their partnerships to identify common areas that most frequently derail agreements.  We will then explore the full range of dispute management and escalation mechanisms that can be used by contract partners at each stage of the development and implementation of a contract or business relationship to prevent disputes from arising or spinning out of control if they do.

The discussion will include an overview and assessment of facilitation, mediation and arbitration, but go beyond these more typical modalities and address other tools developed in a variety of industries to manage disputes in real time.  We will also identify the key principles of dispute resolution management that can be customized to fit any situation.
