Overview

Alliances and joint ventures do not always run smoothly. Conflicts between individuals or the organizations involved may arise around issues such as resource allocation or sharing, staffing, performance/accountability, trust concerns, and personalities.

These disputes can create a roadblock that prevents the JV or alliance from effectively meeting revenue, cost, project, and market targets—and could jeopardize effective future collaboration.

Although the agreement document may provide an arbitration clause to resolve issues or conflicts, the parties may be reluctant to utilize it because it may take too long for resolution, is costly and can create personal/professional resentments because there is a winner and loser.
